1. General Provisions
These Terms of Service set out the rules for using https://www.balkanhome.eu and for the provision of electronic services by Mateusz Sawicki, conducting business under the name "Cometweb", with its registered address at Poland, Rumia, Jachtowa 147/2, Tax ID (NIP): 5882502099, email: contact@balkanhome.eu (hereinafter: the "Service Provider").
These Terms of Service specify in particular:
The Terms of Service are made available free of charge through the Service in a way that allows users to access, reproduce, and store them.
Every user is required to read these Terms of Service before starting to use the Service.

- the conditions for providing services,
- the conditions for entering into and terminating agreements,
- the complaint procedure.
2. Definitions
- Service
- An online platform available under the Service Provider domain, enabling the publication and browsing of real estate listings.
- User
- A natural person, legal person, or organizational unit using the Service.
- Consumer
- A natural person acting for purposes not directly related to their business activity.
- Entrepreneur with consumer rights
- A natural person conducting business activity who enters into an agreement not directly related to their professional business activity.
- Account
- A set of data assigned to a User.
- Listing
- Content published by the User relating to a property.
- Electronic service
- A service provided electronically by the Service Provider.
- Agreement
- An agreement for the provision of electronic services.
- Plan
- A paid subscription that entitles the User to keep a defined number of Listings published at the same time (or an unlimited number, depending on the Plan) for the duration of the paid Billing Period.
- Billing Period
- The period for which the Plan fee is charged: one calendar month (monthly Plan) or one year (yearly Plan), counted from the date of purchase.
- Activation
- A credit purchased before 6 October 2026 under the former pricing, allowing a single Listing to be published for 30 days. Activations are no longer sold but remain valid until used.
3. Types and Scope of Services
The Service Provider offers services consisting of:
Basic services are free of charge, unless expressly stated otherwise.
- enabling the browsing of listings,
- creating and maintaining an Account,
- publishing and managing Listings,
- saving listings as favorites,
- enabling contact between Users,
- offering paid Plans for publishing Listings and, for Users who purchased them earlier, honouring Activations.
4. Technical Requirements
To use the Service, the following are required:
The Service Provider is not liable for problems resulting from failure to meet these technical requirements.
- a device with Internet access,
- an up-to-date web browser,
- an active email account.
5. User Account
Account registration is voluntary and free of charge.
The User is obliged to provide truthful data.
The Service Provider may remove or block an Account in the event of a breach of these Terms of Service.
6. Listings
The User may publish Listings related to real estate.
A Listing should contain reliable and lawful information.
The Listing title and description must not contain contact details or links to external websites, in particular email addresses, phone numbers, or website addresses (such as www or domain names). Contact details should be provided only in the dedicated advertiser contact fields.
The User may edit or delete Listings.
A Listing published under a Plan is live for one month from the moment of activation and is renewed automatically for further monthly periods for as long as the Plan is active and the Plan limit allows it. When the Plan ends, each Listing remains live until the end of its current month.
A Listing activated with an Activation is live for 30 days from the moment of activation. If the User has enabled automatic renewal, such a Listing is renewed for further 30-day periods for as long as the User has unused Activations.
A Listing published under an individual written agreement with the Service Provider remains live until the date set in that agreement.
Deleting or archiving a Listing frees up its place in the Plan limit. A Listing that has expired does not count towards the limit.
7. Responsibility for Content
The User bears full responsibility for the content of Listings.
The publication of the following content is prohibited:
- unlawful,
- misleading,
- infringing the rights of third parties,
- contact details or links in the Listing title or description, in particular email addresses, phone numbers, and website addresses (such as www or domain names).
8. Moderation and the Rights of the Service Provider
The Service Provider may:
These actions may be taken in the event of a breach of these Terms of Service.
- refuse publication of a Listing,
- remove a Listing,
- block an Account.
9. Plans and Automatic Renewal
Publication of Listings under a Plan is subject to a fee. The available Plans, their Listing limits and prices are presented in the Service before purchase. Prices of Plans are expressed in euro (EUR).
The agreement for a Plan is concluded when the first payment is completed in the Stripe checkout. The Plan starts immediately and the User may publish Listings up to the Plan limit.
The Plan is renewed automatically at the end of each Billing Period and the fee for the next Billing Period is charged to the payment method saved during purchase, unless the User cancels the Plan beforehand. The User is informed of the recurring nature of the fee before purchase.
The User may cancel the Plan at any time in the user account. Cancellation takes effect at the end of the current, already paid Billing Period. Until then the Plan remains active, and afterwards each Listing remains live until the end of its current month. Fees already paid are not refunded, in whole or in part.
The User may switch to a higher Plan at any time. The change takes effect immediately, a new Billing Period starts on the day of the change, and the unused part of the current Billing Period is credited towards the new fee. A switch to a lower Plan is possible by cancelling the current Plan and purchasing a new one after the paid Billing Period ends.
If, after a change of Plan, the number of live Listings exceeds the new limit, the excess Listings are not renewed and expire at the end of their current month, starting with those expiring first. The Service Provider never keeps more Listings live than the Plan allows.
If a recurring payment fails, the Service Provider retries the charge and notifies the User by e-mail. Until the payment succeeds, Listings are not renewed and expire at the end of their current month. Once the payment succeeds, Listings that expired in the meantime are restored within the Plan limit. The Service Provider may terminate a Plan whose fee remains unpaid.
A Plan may also be provided under an individual agreement with payment by bank transfer. In such a case the Plan is active until the date agreed with the User and renewal is agreed individually.
The Service Provider may change Plan prices. A price change applies to a User no earlier than from the next Billing Period and the User is notified of it in advance; a User who does not accept the change may cancel the Plan before it takes effect.
10. Payments
Payments are processed by Stripe Payments Europe, Ltd. ("Stripe"). By purchasing a Plan the User authorises Stripe to store the payment method and to charge it for the recurring Plan fee under these Terms of Service.
The Service Provider does not store card numbers or other payment method details; they are processed exclusively by Stripe. The User may update the payment method at any time in the Stripe customer portal available from the user account.
Payments by bank transfer are accepted only under an individual agreement.
11. Invoices
Invoices are issued electronically for each payment. The User agrees to receive invoices in electronic form.
Invoice data (name, address, tax identification number) are provided by the User during payment and may be updated in the Stripe customer portal. The User is responsible for their accuracy.
For Users established in Poland, invoices are issued through the National e-Invoicing System (KSeF). For business Users established outside Poland, the reverse charge mechanism applies in accordance with Article 28b of the Polish VAT Act: the Plan fee does not include VAT and the User accounts for VAT in the country of their establishment, where required.
12. Currencies and Prices
Plan fees are charged in euro (EUR). Property prices in Listings may be presented in different currencies for information purposes.
Currency exchange rates used for presenting property prices are based on data from the National Bank of Poland.
The final price of a Plan, including the Billing Period and the recurring nature of the fee, is indicated before payment is made.
13. No Right of Withdrawal and No Refunds
Plans are intended for real estate agencies, developers and other business users and are provided as a business-to-business service. A business User has no right to withdraw from the agreement for a Plan.
The service is performed in full immediately after payment: the Plan is activated at once, the Listings are published and may be distributed from that moment in search results, newsletters, partner channels and social media of the Service, from which they cannot be recalled. For this reason, by completing the purchase the User expressly requests that the service be performed in full immediately and acknowledges that, upon that performance, any right of withdrawal is lost. This applies also to a Consumer and to an Entrepreneur with consumer rights who, exceptionally, purchases a Plan; the consent and acknowledgement are given by accepting these Terms of Service in the Stripe checkout before payment.
Fees paid for a Plan are not refunded, in whole or in part, including when the User cancels the Plan, stops using the Service, deletes Listings or the Account, or when the Plan is terminated due to a breach of these Terms of Service. The User may stop the automatic renewal at any time, with effect at the end of the paid Billing Period.
14. Complaints
Complaints should be submitted to: contact@balkanhome.eu.
A complaint should include a description of the issue.
A response is provided within 14 days.
15. Liability of the Service Provider
The Service Provider exercises due care in operating the Service.
The Service Provider is not responsible for the actions of Users.
16. Nature of the Service
The Service Provider is not a party to property sale agreements.
The Service Provider is not responsible for the legal or factual condition of any property and is not liable for the content of a Listing.
17. Communication Between Users
The Service enables contact through forms.
The Service Provider is not responsible for the content of communications between Users.
18. Intellectual Property
The contents of the Service are protected by copyright law.
Copying them without the consent of the Service Provider is prohibited.
19. Reporting Violations
A User may report illegal content or content violating these Terms of Service to the Service Provider.
The report should include a justification.
20. Amendments to the Terms of Service
The Service Provider may amend these Terms of Service for important reasons, such as changes in law, changes in the scope or pricing of services, or security requirements.
Users with an active Plan are notified of amendments by e-mail at least 14 days before they take effect and may cancel the Plan before that date if they do not accept them. For other Users, changes take effect upon publication.
21. Governing Law
Polish law is the governing law.
Disputes are resolved by the court competent for the Service Provider.
22. Out-of-Court Dispute Resolution
A Consumer may use out-of-court methods of dispute resolution.
